The term "personal injury" is simply a broad general term used most often to describe an injury to the body, mind or emotions of the victim, as opposed to an injury to the victim's property. In the United States, the term is commonly used to refer to tort lawsuits alleging that the plaintiff's injury has been caused by the negligence, wantonness or willfulness of one or more individuals or business entities.
Damages in personal injury cases are categorized as either special or general. In torts, special damages are measurable costs which can be itemized such as past and future medical expenses, past and future lost earnings, and property damages; whereas, general damages include less easily measurable costs such as mental anguish, disfigurement, pain and suffering, loss of consortium, and emotional distress. Personal injury torts can result in both special and general damages. In some instances, depending on the degree of culpability of the wrongdoer, punitive damages might be appropriate. Punitive damages are awarded for the preservation of human life and to punish and deter others from engaging in similar conduct.
