In the United States, most courts have held that a special relationship exists between an insurance company and its insured, requiring the insurance company to act in good faith toward its insured. In particular, this means that the insurance company is under an obligation to pay when it becomes reasonably clear that a claim is covered. An insurance company is required by law to provide you with the coverage outlined in your policy in exchange for the premiums you pay. If a company defaults on its contractual obligations and does not act in good faith toward policyholders, the policyholder can bring a case against the insurer. Types of Bad Faith Claims
With regard to claims made against you by others, acting in bad faith may include such actions as refusing to provide coverage for a claim, refusing to provide a lawyer to defend you, failing to investigate a claim and unreasonably exposing you to a verdict or judgment in excess of your policy limits. With regard to claims made by you, acting in bad faith may include, denying payment of valid claims, delaying payment of a valid claim, underpaying a valid claim, failing to investigate a claim and other unfair and unscrupulous acts.
